Boback Supports Legislation to Establish a Mandatory Minimum Sentence for Murdering a Child
HARRISBURG - Rep. Karen Boback (R-Columbia/Luzerne/Wyoming) is lauding House passage of legislation that would establish a mandatory minimum sentence of 13 years in a state prison upon conviction for third-degree murder of a victim who is less than 13 years old.

“Current law does not provide a mandatory minimum sentence for third-degree murder of a child, yet mandatory minimum sentences exist for aggravated assault against a child and sexual assault of a child,” said Boback. “This legislation will allow for consistency in sentencing for violent crimes against children, and I am proud to support this effort.”

House Bill 601, sponsored by Rep. Kevin Murphy (D-Lackawanna), would amend the Judicial Code to add a mandatory minimum sentence of 13 years for third-degree murder of a victim less than age 13. The current mandatory minimum sentence for aggravated assault against a victim younger than age 13 is five years, and the mandatory minimum sentence for sexual assault of a child younger than age 16 is 10 years.

“Under our current law, a child murderer could receive less jail time than a child molester,” said Boback. “I applaud Representative Murphy and all my colleagues who supported this legislation for acting to protect those who cannot protect themselves.”

House Bill 601 will now go before the Senate for consideration.
