Boback Calls Passage of Castle Doctrine A Victory for Law-Abiding Citizens

HARRISBURG – Rep. Karen Boback (R-Columbia/Luzerne/Wyoming) lauded the passage of House Bill 40 by the Pennsylvania House of Representatives.  The legislation would eliminate an individual’s duty to retreat before using lethal force to protect home and family.  Boback released the following statement about the bill:


“The passage of this legislation is a victory for law-abiding citizens who will have a defense to civil reprisal if this bill is enacted.  People should have the right to defend themselves and their families from individuals who illegally enter their home with the presumed intent to do bodily harm or kill.  A forced entry into one’s home can never be taken lightly, and the presumption that a perpetrator is there to do injury seems obvious. A person should have the right to stand their ground without having to retreat from their own home.


“I was proud to vote in favor of this legislation, and I was a co-sponsor of the bill.  I have heard from many constituents who support this legislation and view our current system as favoring criminals over upstanding citizens.  I believe everyone has the right to defend his or her own life, as well as the lives of their children and loved ones. A man’s home is his castle. The passage of this bill sends a strong message that Pennsylvania protects law-abiding citizens and, more importantly, allows them to protect themselves when threatened in their own homes.”


House Bill 40 will now advance to the Senate for its consideration.
